Sprinkler System Upgrades

  1. It is the intention of the Company to enter into an agreement to carry out works in respect of which we are required to consult leaseholders.

  2. The works that are proposed to be carried out are as follows (hereinafter referred to as “the Works”):

    Upgrading, testing and commissioning works to the sprinkler system, inspection and, if required, installation or upgrade of fire stopping components, integration of the fire alarm system with the car park communal fire doors in The Habitat Building as required to meet the new regulations under The Building Safety Act 2022 and to meet evacuation strategy requirements under The Regulatory Reform Fire Safety Order following consultation with the Nottingham Joint Audit Inspection Team

  3. We consider that it is necessary to undertake the Works for the safety of the occupiers.

  4. We would hereby invite you to make written observations in relation to the Works by sending your observations to Clermont Management Limited (FAO Art Dembsky) to the address at the bottom of this notice.

    Please note that any observations must be received at the address stated below within the consultation period, which is 30 days from the date of this notice. The consultation period will therefore end on 16 September 2025.

  5. We would also invite you to propose to the address below within 30 days of the date of this notice, details of any person from whom we should try and obtain an estimate for carrying out the Works.

Annual fire door inspections

We have a statutory obligation under the Fire Safety Act 2021 to inspect all fire doors in your building which includes your front door.

For the inspection we will need short access to your apartment to inspect both sides of the door and frames. The team will not need to enter your apartment for any other purpose.

The inspection will only take a matter of minutes and will be conducted by EPS Fire limited who will provide identification on the day.

The inspection will be conducted on Monday May 12th March 28th commencing at 10am

Block B

Apartments 81-136

The inspection will be conducted on Thursday May 15th March 28th commencing at 10am

EWS1: Updates

During the work done by UEFS for the EWS1, several issues were brought to light and needed to be rectified immediately. These were as follows:

  1. The wall capping was not installed properly by the developer to seal the outer walls of the building from water ingress. This allowed moisture to condense in the outer walls and cause damage. The outer wall capping is now properly sealed. £8744.30 Pounds.

  2. Further building work was needed to satisfy internal fire risks. These have now been dealt with. There were several, most have been satisfied without major costs. However, a significant issue was the insulation around common pipes leading into the car park. This required removing the intumescent collar and installing the required fire-retardant materials at the floor level above the false ceilings. £7,286.39 Pounds.

  3. Lower Ground floor flats were vented incorrectly to the car park. These have all been corrected with proper venting, along with associated building works. £1364.70 Pounds.

  4. The electric dry riser cupboards were not adequate for stopping fires from spreading. There were two areas of concern. First were the doors not closing properly or in poor condition. This damage was done by residents. All doors have now been repaired. Your tenants or managing agents need to ensure the doors are properly closed. Use star keys to lock and unlock the doors. Do not force the doors open, breaking the door or frame. If a door is stuck or not freely opening, please advise us. Anyone found damaging the doors will be charged for the repairs. Routinely make sure your agents or tenants have a star key. These can be purchased at any hardware store, or we have extras if needed. Repairs £3,412.00 Pounds.

  5. The electric wires going through the dry riser cupboard had gaps filled with foam which would not prevent fire spreading upward. The foam has now been removed and the air gaps are now closed with retardant boards and sealant. Fire will now be prevented from spreading between the floors through these dry riser cupboards. £10,418.40 Pounds

Whilst we acknowledge this climate of rising costs and high inflation are creating difficulties for everyone, as the Habitat budget does not have surplus funds to meet these exceptional costs, then unfortunately we see no option but to request a sum £224.00 per apartment to help meet these costs in order to achieve a fire-safe building. I would be grateful if you could arrange payment of the attached invoice in due course.

EWS1: External Wall Fire Review

Many of you will have seen that the scaffolding that had been up and around the Habitat went down some months ago and it is with some relief that I can announce that the cladding works at the Habitat have been completed and the EWS1 certificate has finally been obtained.

It has been an ordeal at times and I would like to profusely thank all of those involved, especially:

  • you the leaseholders for your patience and understanding whilst works were ongoing. I know it will have been extremely inconvenient for you all and without your perseverance this would not have been possible.

  • Mark Wells, Mike Fox and their team at MAF Associates were instrumental in identifying what was needed to obtain the EWS1 certificate.

  • Simon Hayes and the team at UEFS (United Envelope Façade Solutions) have been invaluable. Simon kept everyone well informed and made sure any “bumps” were sorted. During their EWS1 work a number of other critical construction issues came to light (see below) and they have addressed these to ensure that The Habitat is a safer and better building for you all.

  • Simon Green from Parking Control. He coordinated with UEFS, keeping all the residents happy and informed on parking.

It has been a long haul for everyone but thankfully with The Habitat now being a safer place for all, it has been worth it.

I also wanted to bring to your attention a number of matters that came to light whilst the building works were being undertaken and which have been addressed. These were:

  • Whilst work was being undertaken on the balconies to replace flammable material it came to light that during the original construction of the building a number of fixing bolts which fixed the balconies to the building had not been installed. This made the balconies potentially dangerous. UEFS have now attended to this and installed all of the missing bolts into the balconies.

  • Fastening the spandrel panels more securely to the building (using 4 fasteners instead of 1 originally used).

  • Properly insulating the cavities between floors.

UEFS have also identified another issue in respect of the wall capping not sealing the outer walls properly. This work is currently being undertaken and it should be completed by the end of this year.

The building works also identified a number of internal building issues and we are working to deal with these. Those works shall continue into 2024 in order to minimise disruption to the occupiers. These works include:

  • insulation in the car park area

  • installation of correct extractor vents the car park

  • dry riser insulation throughout the building

Updates will be made available here when those works are completed.

A copy of the EWS1 certificate is attached for your reference. Please keep it safe as you will need to produce it if you are selling or remortgaging your flat.
